Terms of Service

Effective: October 25, 2026 · Last updated: October 25, 2026

These Terms of Service (“Terms”) govern access to and use of Caters.ai websites, applications, AI-assisted catering tools, communications, payment features, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you may bind that organization.

1. The Service

Caters.ai provides software that helps catering businesses and customers communicate, prepare menu proposals, manage leads, create orders, and access third-party payment services. AI-generated suggestions may be incomplete or inaccurate and must be reviewed before reliance. Caters.ai is a technology platform and is not the caterer, customer, payment processor, or party responsible for preparing or delivering food unless expressly stated.

2. Accounts and eligibility

You must be legally able to enter a contract and provide accurate, current information. You are responsible for account credentials and activity under your account. Notify us promptly of suspected unauthorized access. Business users are responsible for managing their staff access and permissions.

3. Business and customer responsibilities

Businesses are responsible for menus, prices, taxes, availability, allergen and dietary information, permits, fulfillment, refunds, customer communications, and compliance with food-safety and consumer laws. Customers are responsible for reviewing proposals, disclosing relevant dietary needs, confirming event information, and paying agreed charges. A proposal is not guaranteed until accepted by the applicable business.

4. Communications and email choices

We may send service communications necessary to operate accounts or deliver requested information. Optional lead-follow-up reminders require the preference or lawful basis described in our Privacy Policy and include a way to unsubscribe. You may change eligible reminder preferences through the Service. Unsubscribing from promotional reminders does not prevent strictly transactional messages that you request or that are necessary for an existing transaction.

5. Payments

Payments may be processed by third-party providers such as Stripe. Their terms and privacy practices also apply. Businesses determine charges, deposits, cancellations, refunds, and taxes unless the Service states otherwise. Caters.ai does not guarantee payment authorization, settlement, refund, or dispute outcomes.

6. Acceptable use

You may not misuse the Service, violate law, infringe rights, send unlawful or deceptive communications, upload malicious code, interfere with security, scrape the Service without permission, impersonate others, attempt unauthorized access, or use generated content to facilitate harm, discrimination, fraud, or spam.

7. Content and licenses

You retain ownership of content you submit. You grant Caters.ai a worldwide, non-exclusive license to host, process, reproduce, and display that content as needed to provide, secure, improve, and support the Service. You represent that you have the necessary rights. Feedback may be used without restriction or compensation.

8. Intellectual property

The Service, software, designs, trademarks, and documentation are owned by Caters.ai or its licensors and protected by law. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

9. Third-party services

The Service may link to or integrate with third-party AI, hosting, authentication, email, analytics, and payment providers. Caters.ai is not responsible for third-party services, and their terms may apply.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for breach, security risk, nonpayment, legal requirements, or material harm to the Service or others. Provisions that logically survive termination—including ownership, disclaimers, liability limits, and dispute terms—remain effective.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and warranties arising from course of dealing. We do not warrant uninterrupted operation, error-free AI output, successful transactions, or catering quality.

12. Limitation of liability

To the maximum extent permitted by law, Caters.ai and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, food-service claims, or third-party conduct. Caters.ai’s aggregate liability arising from the Service will not exceed the greater of US$100 or fees you paid Caters.ai during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so they apply only to the extent lawful.

13. Indemnification

Business users agree to defend and indemnify Caters.ai from third-party claims arising from their menus, services, customer communications, legal violations, content, or misuse of the Service, except to the extent caused by Caters.ai’s own unlawful conduct.

14. Changes

We may update the Service and these Terms. Material changes will be communicated as required by law. Continued use after an effective date constitutes acceptance where permitted; otherwise, we will request renewed agreement.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts located in California will have exclusive jurisdiction unless applicable consumer law requires otherwise. Before filing a claim, contact us and allow 30 days for informal resolution.

16. Contact

Questions about these Terms may be sent to legal@caters.ai. Business identity and mailing-address details should be confirmed by Caters.ai before production publication.
